K1 and K3 Visas for your squeeze


Any experience with this?

Got into a great conversation with a long-time friend at Drinking Liberally last Monday as to the best way to bring your foreign finance or spouse back to the US.

The crowd had lots of advice, of course, some of it first-hand experience and some of it general impressions as to how the system works.

The most interesting discussion was, "which is better ...the K1 or the K3?"

The K1 is doing all the paperwork in advance of getting married in the US.  The K3 is getting married outside the US ...then doing all the paperwork necessary for the happy couple to then live and work back in the USA.

From my wife´s and my personal experience, the K1 (fiance visa) seemed to be the fastest track to allow her to get her work permit.  But apparently, the K3 (get married here first visa) could be just as quick if not quicker for an "employment purposes" Social Security card.

What has been your personal experience?  If you had to do it all over again, would you do it differently? (the visa NOT the marriage!)

Hi Mike

We did a K1 visa and wished we had done the K3. Not sure of the difference in time to work, but by doing the K1 my wife had to wait in Argentina alone for 6 months (waiting on the embassy). If we had done the K3 she could have gone to the states right away.

I gotta question for ya... if you had been able to remain in Argentina for those 6 months, would the K1/K3 have been a toss-up?

Hadn't thought about it. I guess then if we where looking to move right back then the K3 would make more sense because it can be done from the US.

Yeah. That´s the thing. Everybody is in a slightly different situation ...it makes advice-giving kinda tough. But that doesn´t mean all our stories don´t help.

Tell me somethin´, how long ago was your experience? The new-INS has gotten pretty tough recently on all forms of this.

Awe, it's funny to run into this here. David and I applied for the K1 visa earlier this year and we're happy to see that everything went through just fine! =D There's only one more step and I'll be traveling (with Dimitri, my cat)and getting married in California, yay!

Any adice on how to travel to the USA with a cat???? Thanks a lot!
